Licensing of online casinos by Peru

Peru moved from regulating physical casinos and slot halls to a full framework for remote gambling. The starting point was Law No. 27153 in 1999 for land‑based casinos and slot machines, refined by subsequent rules and the Supreme Decree No. 009‑2002‑MINCETUR. For the online sphere, Peru enacted Law No. 31557, which regulates remote games and remote sports betting, and approved detailed technical rules by MINCETUR. A later update, Law No. 31806, adjusted several operational points, including permitted domains and financial guarantees. The competent authority is the General Directorate of Casino Games and Slot Machines (DGJCMT) within the Ministry of Foreign Trade and Tourism (MINCETUR), under the Vice‑Ministry of Tourism. This authority authorizes, registers, supervises and sanctions operators and key suppliers.

The way a licensed online casino must operate is precise. Every platform, game and progressive jackpot system must be tested and certified by independent laboratories authorized by MINCETUR. The platform must keep exact, tamper‑proof records of player registration, all bets, wins, payments and account actions, and preserve them for at least five years. One person may hold only one account per operator, and access is strictly 18+. People listed in the national register of persons prohibited from accessing casino and slot venues are also blocked online. Before play or transactions, operators must verify your identity and age, and the payment instrument you use must belong to you.

Fairness and security are not treated as slogans. Only certified random number generators are allowed; critical components are integrity‑checked; all sensitive data must be encrypted; platforms run backups, disaster recovery and undergo periodic audits, including penetration testing. Operators must display clear rules and probabilities, including return to player not below 85%, and show the MINCETUR authorization code on the site. They must also keep a dedicated bank account in a financial institution supervised by SBS exclusively for player deposits and stakes, and are not allowed to put your account in overdraft. Operations with cryptocurrencies are categorically prohibited by the regulation.

Responsible gambling obligations are embedded in Peruvian law. Online platforms must provide self‑exclusion and self‑limitation tools and carry the warning that “online games and sports betting may cause gambling addiction.” Peru also maintains a formal exclusion register administered by MINCETUR; casinos and slot halls must deny entry to those listed, and online operators must prevent their participation. Beyond the online‑specific regime, Peru’s Law No. 29907 and its regulation obligate operators to inform about risks, protect the confidentiality of excluded persons, and run prevention plans against problem gambling.

As for oversight, DGJCMT conducts regular and ad‑hoc inspections. Sanctions range from fines to suspension or cancellation of authorizations. Repeated violations escalate penalties, and non‑authorized activity can trigger closures, domain and IP blocking, seizure of equipment, and even criminal liability for illicit operation under the newer law.

Limits and taxes

Peruvian rules require every licensed platform to offer player‑controlled limits and self‑exclusion, but they do not set a statutory universal maximum bet or deposit cap. What is explicit is the financial hygiene: payments in and out must go through identified banking and payment instruments in the player’s name, funds are segregated in a dedicated account, transfers between player accounts are not allowed, and crypto is off‑limits.

There is a specific tax on remote games and remote sports betting borne by the operator. It is assessed monthly at 12% of the defined tax base calculated from stakes, prizes, returns and a standardized deduction for platform maintenance. SUNAT administers the tax, and its proceeds are shared among the Treasury, the Health Ministry for mental health programs, MINCETUR, and the national sports institute, as set by law. The legal texts do not state a withholding on player winnings in this regime; the tax targets operator income.

How to verify that a casino holds a Peruvian license

Begin on the casino’s own site. Licensed platforms must visibly show their MINCETUR authorization code and carry the mandatory responsible‑gaming warning. The domain can be operated under .bet.pe and, after the legal update, also .bet, .com, .pe or .com.pe, but only with valid authorization. Cross‑check the claim in MINCETUR’s public registries: the ministry maintains official registers of technological platforms, right‑holders (authorization holders), approved game software, progressive systems and more. Open the registry portal and navigate to the sections for technological platforms and authorization holders to confirm that the brand and its platform appear with an active status. The registry gateway is here: MINCETUR gambling registries. For the technical regulation itself, you can read the published Supreme Decree with the online standards: DS N° 005‑2023‑MINCETUR.

How to file a complaint about a Peruvian‑licensed online casino

Start with the operator. Peruvian rules oblige licensed platforms to keep auditable records and to give you access to at least two years of your transaction history, so state your case to customer support in writing and keep copies. If the dispute is not resolved, escalate to the regulator. The competent authority is MINCETUR’s General Directorate of Casino Games and Slot Machines (DGJCMT). You can file through MINCETUR’s Virtual Desk or submit at the central “mesa de partes” in Lima. The ministry’s address is Calle Uno Oeste 050, Urb. Corpac — San Isidro, Lima, Peru; the direct phone line is (51.1) 513 6122. The thematic page for gaming procedures is available here: MINCETUR — Gaming rooms.

After you file, expect an administrative process: DGJCMT can require information from the operator, conduct inspections and, where applicable, impose corrective measures or sanctions under Law No. 31557 and its regulation. In parallel, if your case relates to problem gambling or exclusion, MINCETUR manages the exclusion register, including voluntary and family‑requested entries. The official guidance and forms for self‑exclusion are published here: Self‑exclusion register (MINCETUR).

Important reminders for players. Only play on platforms you can find in MINCETUR’s registries, look for the authorization code on the site, avoid any operator that accepts crypto, and use the built‑in tools to set your limits or self‑exclude when needed.
