Legislative norms of online casinos in Belarus

Regulation and licensing

In Belarus, presidential decree «On measures to improve the use of the national segmet of the Internet» of 2019 allows online:

• casinos,
• automatic machines,
• totes (bets).  

The decree «Оn  improving the legal regulation of gambling business» determines that online casinos» activities are issued licenses for the «content of virtual gambling establishment».   

Regulators are the Ministry of Taxes and the Ministry of Finance. They determine the legal regulations for land-based casinos, virtual betting offices, sports betting, lotteries, and automatic machines. 

The Ministry of Finance regulates tax rates. The Ministry of Taxes and Levies accepts online resource profit reports and issues licenses for gambling activities. 

The basic requirements that a licensee must meet:

1. Absence of criminal records (including administrative records) of the manager and his deputy for violation of the legislation in the sphere of legalization of income, terrorist activity, arms distribution. 
2. Availability of a license (valid for more than the last two years) issued in Belarus for online or land casinos. 
3. Software compliance with the requirements of the Council of Ministers of the Republic of Belarus.

The licensee's bank account must have sufficient funds to pay taxes, fees and winnings. 

The service provider must:

save personal information on internal servers of the country;

• provide certified software;
• be certified by the Ministry of Finance;
• transfer personal information about the movement of funds to the Gambling Business Monitoring Centert;
• use current bank accounts opened in the Republic of Belarus for settlements;
• have quarterly funds in the amount determined by the Council of Ministers of the Republic of Belarus on the first day of the first month;
• provide access to the resource for government agencies;
• meet the requirements specified by the Council of Ministers for payments, quality and functions of the software, and site content;
• connect to Special Computer Cash Management System (SCCS). 

The software must meet government standards. You can test, set up, the server of a gambling establishment on the SKKS website, apply, and study the requirements for network creation. 

The Law «On Taxes and Duties of the Republic of Belarus» establishes a tax rate of 4% for players» winnings. The loss of the user tax pays online casinos (13% of profits).

Contacts addicts, their families, and technical support

Since 2013, the Belarusians can limit their access to gambling establishments. Gambling Business Monitoring Center provides samples of applications for addicts and their close ones. 

The term of the restriction is from six months to three years. You can check whether a player is on the list of banned persons on the site, the stop-list of about 60 thousand people.  

The application is submitted to the police by the player, his family, or relatives. SKKS staff after the court order blacklists the addicts, restricting his access to online casinos. The provider blocks the account. 

There are no specialized clinics to treat gambling addicts in the country. Players advised going to private and public hospitals, which treat alcohol, drug, food, and nicotine addiction in Minsk. In severe cases, psychiatrists or psychologists come home to the patient.
